Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Developing Media LLC ("Company," "we," "us," or "our") concerning your access to and use of the String Coach application (the "App").

By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

Description of Service

String Coach is an educational application designed to help violin, viola, and cello players learn and memorize notes on the fingerboard through interactive exercises and games.

Eligibility

The App is available to users of all ages. If you are under 13 years of age, you may only use the App with the consent and supervision of a parent or legal guardian. By using the App, you represent that you have the necessary consent if you are under 13.

User Accounts

Currently, String Coach does not require user registration or accounts. You can use the App without providing personal information. If we introduce user accounts in the future, additional terms will apply.

License and Restrictions

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

Restrictions

You agree not to:

• Modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App's functionality or servers
• Attempt to gain unauthorized access to any part of the App
• Use automated systems or software to extract data from the App
• Sell, rent, lease, or sublicense access to the App

Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by Developing Media LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

User Content and Data

Your practice data and preferences are stored locally on your device. You retain all rights to your data. We do not claim ownership of any data you generate while using the App.

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of content

We do not warrant that the App will meet your requirements or that any defects will be corrected.

Educational Purpose

String Coach is designed as a supplementary educational tool. While we strive for accuracy in all musical notation and fingerboard positions, the App should not be relied upon as the sole source of musical instruction. We recommend using the App in conjunction with proper instruction from qualified music teachers.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DEVELOPING MEDIA LLC SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or use
• Any damages arising from your use or inability to use the App
• Any damages arising from unauthorized access to your device or data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO ACCESS THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

Indemnification

You agree to indemnify, defend, and hold harmless Developing Media LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

Third-Party Services and Links

The App may contain links to third-party websites or services that are not owned or controlled by Developing Media LLC. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

Modifications to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Updates and Changes

We may release updates to the App from time to time. These updates may include bug fixes, new features, or improvements. You may need to update the App to continue using it. Some updates may be required for the App to function properly.

Termination

We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. You may terminate your use of the App at any time by ceasing to access it and deleting it from your device.

Geographic Restrictions

The App is controlled and operated from the United States. We make no representations that the App is appropriate or available for use in other locations. If you access the App from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in [Your County and State], and you irrevocably consent to the jurisdiction of such courts.

Dispute Resolution

Informal Resolution

If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email.

Arbitration Agreement

If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the App will be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, and there is no right or authority for any dispute to be arbitrated on a class-action basis or to utilize class action procedures.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Developing Media LLC regarding the use of the App and supersede all prior agreements and understandings, whether written or oral.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
